The Buyer acknowledges and agrees that Warhorse Overland, LLC shall not be liable for any bodily

injury, death, or property damage that may occur as a result of the Buyer's use of the trailer. The Buyer assumes all risks associated with the use of the trailer, including but not limited to, the risk of injury, death, or property damage. The buyer absolves Warhorse Overland, LLC of any liability associated with the operation of this trailer(s). This exculpatory clause is made pursuant to Colorado Revised Statutes

Section 13-22-107.

 

BUYER Responsibilities:

 

Seller is not responsible for Timbren malfunctions or any other non-Warhorse manufactured items.  Buyer is responsible for all maintenance on trailer.

 

Maintenance –

Ensure wheels are torqued to 110 ft/lbs

Ensure Axles are greased and Cotter Pin in-place/secured prior to trip

 Ensure Timbren Axles are torqued to Required Spec

Intellectual Property Protection Clause

By purchasing any product from Warhorse Overland, the Buyer acknowledges and agrees that all designs, plans, schematics, and specifications provided or referenced in the sale of this product are the exclusive intellectual property of Warhorse Overland. The Buyer agrees not to reproduce, reverse-engineer, modify, distribute, or create derivative works based on any part of the product design, either in whole or in part, without prior written consent from Warhorse Overland. Any unauthorized use of Warhorse Overland's intellectual property will result in legal action for the protection of these rights.
